Terms And Conditions
1. Application and Entire Agreement
These Terms and Conditions apply to the provision of the services detailed in our quotation (Services) by Brilliant Web Design Ltd, a company registered in England and Wales under number 15135548, whose registered office is at 1 Cornfield Road, Rowley Regis, B65 8HJ (we or us or Service Provider) to the person buying the services (you or Customer). You are deemed to have accepted these Terms and Conditions when you accept our quotation or from the date of any performance of the Services (whichever happens earlier), and these Terms and Conditions and our quotation (the Contract) constitute the entire agreement between us.
2. Interpretation
In these Terms and Conditions:
- "Services" means the web design, web development, hosting, domain registration, and SEO services provided by Brilliant Web Design Ltd.
- "Client" refers to the individual or entity receiving services from Brilliant Web Design Ltd.
- A "business day" means any day other than a Saturday, Sunday or bank holiday in England and Wales.
3. Your Obligations
As a client of Brilliant Web Design Ltd, you agree to:
- Provide accurate and complete information necessary for the provision of services.
- Abide by all applicable laws and regulations relating to the use of our services.
- Cooperate with Brilliant Web Design Ltd in a timely manner to facilitate the delivery of services.
4. Fees
4.1 Payment Terms
You agree to pay all fees and charges associated with the services as outlined in the applicable invoice provided by Brilliant Web Design Ltd.
4.2 Deposit Payment
Brilliant Web Design Ltd will only commence work on a project after receipt of the agreed deposit payment of the quoted project fee from the client. The rest of the payments is to be made on progress on the project based on agreed terms. The website will be switched to live once the clients remaining balance is paid in full.
4.3 Late Payment
Failure to make timely payments may result in suspension or termination of services.
4.4 Refunds
Brilliant Web Design Ltd reserve the right to decide whether a refund is applicable if requested by the client for any reason. A refund is not guaranteed by Brilliant Web Design Ltd.
5. Cancellation and Amendment
We can withdraw, cancel or amend a quotation if it has not been accepted by you, or if the Services have not started, within a period of 15 days from the date of the quotation, (unless the quotation has been withdrawn).
Either we or you can cancel an order for any reason prior to your acceptance (or rejection) of the quotation.
If you want to amend any details of the Services you must tell us in writing as soon as possible. We will use reasonable endeavours to make any required changes and additional costs will be included in the Fees and invoiced to you.
If, due to circumstances beyond our control, including those set out in the clause below (Circumstances beyond a party's control), we have to make any change in the Services or how they are provided, we will notify you immediately. We will use reasonable endeavours to keep any such changes to a minimum.
6. Payment
6.1 Method of Payment
Payments for services rendered by Brilliant Web Design Ltd shall be made via the designated payment methods specified in your service agreement.
6.2 Billing Cycle
Billing cycles for services shall be as agreed upon between Brilliant Web Design Ltd and the client.
7. Termination
Brilliant Web Design Ltd reserves the right to terminate services at any time for non-compliance with these Terms and Conditions or for any other valid reason.
8. Intellectual Property
8.1 Ownership
All intellectual property rights in materials produced by Brilliant Web Design Ltd as part of the services shall remain the property of Brilliant Web Design Ltd unless otherwise agreed in writing.
9. Liability and Indemnity
Brilliant Web Design Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the services provided.
10. Communications
All communications between you and Brilliant Web Design Ltd shall be conducted in writing via email or through the designated communication channels specified in your service agreement.
11. Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Circumstances beyond Brilliant Web Design Ltd's control
Brilliant Web Design Ltd is not liable for any failure or delay in performing our obligations where such failure or delay results from any cause that is beyond our reasonable control. Such causes include, but are not limited to: technological issues, server downtime, software bugs, internet connectivity issues, third-party service outages, cyber-attacks, or any other event that is beyond our control. If the delay continues for a period of 90 days, Brilliant Web Design Ltd reserves the right to terminate or cancel the Services outlined in these Terms and Conditions.
13. Reporting Abuse & Complaints

For any complaints regarding our services, please contact us at . We take all complaints seriously and will endeavor to resolve any issues promptly and efficiently.
3.2 Procedure
Upon receiving a complaint, we will acknowledge receipt within 24 hours and initiate an investigation into the matter. We will keep you informed of the progress and strive to reach a satisfactory resolution as soon as possible.
14. Renewals
If a domain name is purchased by the client through a company other than Brilliant Web Design Ltd, the client has full responsibility in making sure that the domain name is renewed when due. We will not renew the domain name when annual hosting renewal is due if the domain name is purchased through a company other than Brilliant Web Design Ltd.
Brilliant Web Design Ltd will issue an invoice 30 days prior to a Clients domain name expiring. If the Client does not pay the renewal charges the domain name will not be automatically renewed on behalf of the client.
